Did you know you can grant a friend, family member or professional adviser powers to make decisions on your behalf in your best interests?
Mackarness & Lunt can advise you on existing Enduring Powers of Attorney that you may have in place as well as advising you as to whether you should consider putting in place Lasting Powers of Attorney (LPAs) to enable others to speak for you and make decisions on your behalf. There are two types of LPAs:
- 1. For Financial and Property decisions which allows your attorney authority to deal with your property and finances as soon as it has been registered. This means that you can ask your Attorneys to do certain things for you immediately provided that you have mental capacity to do so and the Attorneys must do as you ask. If you lose mental capacity to make a decision about your finance or property then your Attorneys would be able to make the decision for you so long as it is in your best interest and they have consulted you about it.
- 2. For Health and Welfare decisions which allows your Attorneys to make welfare and health care decisions on your behalf when you lack mental capacity to do so yourself. At all points when you have capacity the LPA remains in place but cannot be used to overrule your wishes. The LPA also, if you wish, allows you to give your Attorneys the power to give or refuse consent to the continuation of life sustaining treatment for you when you do not have capacity. Should you face health issues in the future, you’ll want a person, or people that you can trust to make decisions on your behalf. You may need someone to make a decision about your health and day to day living arrangements, or to help you deal with bills, savings/investments, property and other financial affairs. We can help you arrange the necessary paperwork to allow your Attorneys to manage your finances, property and welfare, ensuring the appropriate restrictions and levels of authority are in place which you feel comfortable with.
There are two types of LPAs:
